Proposed Regulation NV OSHA (R110-25) - Written Comment to Commission
“If he has a right, and that right has been violated, do the laws of his country afford him a remedy?”
“The very essence of civil liberty certainly consists in the right of every individual to claim the protection of the laws whenever he receives an injury. One of the first duties of government is to afford that protection.”
“The Government of the United States has been emphatically termed a government of laws, and not of men. It will certainly cease to deserve this high appellation if the laws furnish no remedy for the violation of a vested legal right.”
- U.S. Supreme Court, Chief Justice Marshall, Marbury v. Madison, 5 U.S. 137 (1803)
The Division of Industrial Relations has adopted regulatory changes which manifest an infidelity of the Governments obligation to its Citizens.
Ubi Jus Ibi Remedium
A Latin legal maxim meaning “where there is a right, there is a remedy.” This principle holds that for every violation of a right; the law must provide a means to address the grievance. Adequate relief must apply when an injury is sustained as violation occurs.
Equitable remedies shall be sufficient to act as a deterrence.
What remedy would suffice for a human life?
As profits and pockets seem to have taken hold of the soul of this country, I ask you to consider the remedy of any violations as a business or a corporation would:
What is the value of our daily, monthly, and annual operational costs VS. a human life, an arm, or a leg .…and which is cheaper in comparison to the bottom line?
If the cost of a human life and/or the penalties for safety violations outweigh the cost savings of operational costs, compliance is surely achieved. A Father, Mother, or your Child goes home safely, to be loved and cherished, living another day.
I urge you to keep the penalties as valuable as you are, as We the People are.
Thank you for your time and making the right decision to support the safety of the lives of the people in our community and the people we represent.
